EWHIP Terms & Conditions

1. By completing and signing this form and contract, I acknowledge my participation in this activity, which is strenuous, adventurous, and possibly physically demanding.

2. I recognize that whatever activity I choose to participate in could incur any type of risk, injury, and/or death.

3. I acknowledge that it is not recommended that I participate in any activity physically demanding if I am pregnant, I have a delicate cardiac or mental condition and/or if I am not physically able to move at the fast pace of a group, due to the additional risk of injury and/or death of myself or any of the other members of the group.

4. I acknowledge that with my signature I release Ewhip Electric Moto CO, its representatives, affiliates, advertising media, agents, local promotion and all Ewhip controlled guides from any liability arising from any possible injury and/or death.

5. The above includes and is not limited to the total or partial cost of medical care or treatment, hospital costs, ambulance transportation costs, medical prescriptions, emergency evacuations to my country of origin and/or any other legal or monetary expense. which is incurred.

6. This includes accidents resulting from natural disasters, my own negligence and/or the negligence that in a given case is the responsibility of Ewhip and all of its aforementioned collaborators.

7. I recognize that any possible precaution that affects the development of the tour must be taken for the good and safety of myself and the members of my group.

8. The vehicle has been delivered to me in excellent condition (with respect to bodywork, paint and mechanical condition) and I acknowledge that it is my responsibility to return it in the same condition.

9. In the event of damage, I acknowledge that I will be charged the price of new parts plus a 50% adjustment on the total amount available to cover the labor for the repair and the vehicle.

10. I agree to provide a valid credit card on which a maximum of $500 dollars is retained as a security deposit on your vehicle and that of your companions. The security deposit ensures the payment of the vehicle rental, any excess time over the agreed rental period and the repair or replacement of any damage caused. The deposit will be retained on the credit card or in cash, in the event that the amount of the deposit is insufficient to cover the expenses, the client will be obligated to pay the remaining balance.

11. I recognize that the vehicle only has the basic insurance required by law.

12. The vehicle will be used strictly for the transportation of the client and his companion; in addition, the client recognizes that:

– You may not allow someone other than yourself to drive the vehicle.
– You should not drive in the vehicle if you do not have all the necessary documentation (passport)
– You should not drive under the influence of alcohol and/or other drugs.
– Any traffic fine will be the responsibility of the client.
– You should not demand the vehicle above its capacity.
– Do not drive on deteriorated roads that increase the risk of accidents or restricted areas such as beaches or private property.

13. If you do not comply with the above stipulations, the tooth will be responsible for paying for any damage to the property of third parties.

14. Ewhip will not be responsible if the tooth does not comply with the requirements stipulated for circulation in Costa Rican legislation (passport).

15. I recognize that it is my responsibility to respect traffic signs, speed limits and maintain a safe distance from other vehicles.

16. I acknowledge that it is my obligation to wear a helmet every time I use the vehicle.

17. At the time the contract is terminated, the client must pay:

-Mechanical damage and repairs due to accidents caused by negligence. Legal expenses, lawsuits, taxes and paperwork caused by failures to comply with the provisions of this contract (traffic fines, damages to third parties or their property)

-Loss of legal circulation documents and/or metal plate.
-Loss of vehicle key.

18. The tooth and his companions release Ewhip and all its associates and collaborators from responsibilities for loss of personal belongings lost during our activities or forgotten in the vehicle.

19. I acknowledge that it is my responsibility to pay for any damage that occurs to the vehicle, passenger or third parties.

20. Both parties, eWhip and the tooth, recognize that in the event of a collision, overturn or damage and injuries caused to third parties, eWhip will deduct such expenses from the guarantee deposit whether or not the responsibility is assumed by the client and applies from partial loss or total.

21. There will be no refund for lost time in the event of a mechanical failure or a flat tire.

22. I recognize that it is my responsibility to assess the condition of the vehicle at the time it is delivered to me, the vehicle will be inspected upon its return for any damage caused.

23. The rented vehicles will be delivered with a full tank of fuel, therefore, I undertake to return it in the same way or the cost of gasoline will be charged.

24. In the event of an accident where, due to the terrain conditions, the vehicle cannot be recovered and put back on top, the owner must pay an additional sum for the ransom payment since this requires the hiring of specialized services.

25. Whatever the situation in which a customer requests roadside assistance, whether due to negligence or negligence, an additional charge will be made depending on the conditions of the situation.

1. The use of a helmet and reflective vest is required by law in Costa Rica.

2. Once the tour has started, stay in line, it is prohibited to overtake other Tour Members.

3. The guide is always in front of the tour, follows all his instructions.

4. All types of tricks or pirouettes (skids, jumps, etc.) are prohibited.

5. Maintain a safe distance of approximately 5 meters between you and other vehicles.

6. When stopping or slowing down, use the front and rear brakes.

7. Pay close attention to the operating instructions.

8. If you ignore the warnings and precautions indicated above, please note that the vehicle remains in your custody and you will be fully responsible for any damage that occurs.

9. There is no refund.

10. Do you have any questions or comments? Do not hesitate to consult your guide, it will be a pleasure to assist you.

11. At the time of purchasing the vehicle and signing these documents we assume that everything has been read, analyzed and the vehicle inspected.

By signing this contract, the customer assumes full responsibility for damage to the vehicle and agrees that his or her card will be charged the full amount of all related charges, including the total cost in the event of theft of the vehicle.

Likewise, I acknowledge and accept the clauses, warnings and precautions described above.

In the event of unfavorable weather conditions, eWhip may make the decision to reschedule the activity, there is no refund.
